Acceptable Use Policy

This Acceptable Use Policy (AUP) applies to all services of D-Labs IT (Chamber of Commerce 86752812, established in Schiedam, the Netherlands): web hosting, VPS, domain registration, email, DNS and related infrastructure. It binds every Customer and every person using the services through the Customer — end users, staff, the Customer’s own customers or other sub-users. The Customer is responsible for compliance by all of them. This policy supplements our Terms & Conditions; in case of conflict over acceptable use, this policy prevails.

The services may be used for lawful business and personal purposes, in accordance with this policy, the Terms & Conditions and all applicable law. Reasonable, non-excessive use of shared resources (compute, storage, bandwidth, email volume) is permitted. D-Labs IT may set fair-use limits and take technical measures to protect the availability and security of the services for all customers.

The services may not be used, or allowed to be used by a third party, for:

• acts or content that breach any law or regulation;
• infringement of third-party intellectual-property rights (piracy, illegal streams, unauthorised distribution);
• malware, viruses, hacking, unauthorised access to systems or circumventing security;
• phishing, fraud, scams, identity theft or deception;
• sending spam or unsolicited bulk messages in breach of law and regulation;
• (distributed) denial-of-service attacks, port scanning, spoofing or other network abuse;
• material depicting child sexual abuse (CSAM) — zero tolerance: immediate removal and reporting to the authorities;
• hate speech, defamation, harassment, threats or incitement to violence;
• unlawful processing or distribution of personal data;
• unauthorised cryptomining or deliberately exhausting shared resources;
• trading in or distributing illegal goods, weapons, drugs or stolen data.

Risky or restricted activities — such as large-scale email/marketing platforms, financial services, gambling or adult content where legally permitted — are allowed only after prior written agreement and any additional conditions.

The Customer uses the services in accordance with all applicable Dutch and EU law and, where relevant, foreign laws and regulations. The services may not be used in breach of export-control or sanctions law. It is prohibited to provide the services to, or use them for the benefit of, persons, entities or countries subject to EU, UN or other applicable international sanctions. The Customer is responsible for the licences, notifications and registrations its activities require.

Where the Customer offers the services wholly or partly to third parties — for example as a reseller, or via its own website or application with its own users — the Customer remains fully responsible for the conduct, use and content of those end users. The Customer imposes on its end users obligations at least equivalent to this policy and handles complaints about them itself. D-Labs IT may hold the Customer accountable for breaches by its end users.

D-Labs IT does not routinely monitor the content of customer traffic, but has the right to investigate upon a report, a legal obligation or a concrete suspicion of abuse. In the event of a breach, D-Labs IT may — depending on severity and, where possible, after warning and a reasonable cure period — remove or disable content, suspend the service in whole or in part, or terminate the agreement with immediate effect. In urgent cases (such as active malware, CSAM, an ongoing attack or a court order) D-Labs IT intervenes immediately, without prior warning. D-Labs IT cooperates with lawful requests from competent authorities. Suspected abuse? Report it to abuse@dlabsit.nl.
